The co-owner of a South Lakeland farm is to be prosecuted after an employee was found dead under the wheel of a tractor. The Health and Safety Executive (HSE) is bringing criminal proceedings against Stuart Webster following the death of Thomas Phizacklea at Aurora Park Farm in Scales near Ulverston.
The 34-year-old from Dalton-in-Furness was found trapped between a tractor wheel and a bank of earth on 2 July 2009. Stuart Webster has been charged with breaching Regulation 5(1) of the Provision and Use of Work Equipment Regulations 1998. The offence relates to failing to ensure the tractor was in good working order.
He is due to appear at Barrow Magistrates’ Court on 16 October 2012 for the first hearing in the case.
